Terms of service
Last updated: 22 October 2026
1. Who we are
yvinedesign.com is run by Yvine Design OÜ, registry code 17537655, VAT number EE103023609, Estonia. Email: yvinedesign@gmail.com. These terms apply to every order on this site. By placing an order you accept them.
2. Orders and contract
- The pictures and descriptions on the site are an invitation to buy, not a binding offer. Your order is your offer; the contract is made when we confirm the order by email.
- An original exists only once. If the same piece is ordered twice at the same moment, the first paid order wins and we refund the other in full.
- If a price or description is clearly wrong (an obvious typing or technical error), we may cancel the order before shipping and refund everything you paid.
- The contract is concluded in English, Estonian or Russian, the language of the site you ordered on. We keep a copy of your order; you receive it by email.
3. Prices and payment
- Prices are in euros and include VAT where it applies (24% Estonian VAT for orders delivered within the EU). The checkout shows the exact tax before you pay. Delivery is shown separately at checkout.
- Businesses in other EU countries with a valid VAT number pay no VAT; the reverse charge applies and the invoice says so.
- Payment is taken at checkout by card, Apple Pay, Google Pay or Shop Pay. Payments are processed by Shopify Payments; we never see your full card details.
- An item remains our property until it is paid in full.
4. Delivery
Delivery times, prices and customs are described in our Shipping policy. Risk passes to you when the item is delivered to you or a person you name.
5. Cancellations, returns and faults
Your right to cancel, its exceptions (commissions, personalised work, digital products once supplied) and what happens if an item is faulty are set out in our Refund policy.
6. Artworks and copyright
- Buying an artwork gives you ownership of that physical piece. All copyright stays with the artist. You may display, lend and resell the piece, but you may not copy, print, photograph for sale, or otherwise reproduce it or use it commercially without written permission.
- The artist may continue to show the work (photos, portfolio, exhibitions catalogues, social media) after the sale.
- The images, texts and designs on this site are protected by copyright. Do not copy them without our permission.
- Prints are produced in editions; an edition number does not give any reproduction rights.
7. Commissions
Commissioned work is agreed in a written quote (size, materials, price, timing, deposit). The quote's terms apply together with these terms. Because a commission is made to your specifications, the 14-day right to cancel does not apply. If you cancel a commission after work has started, we keep the part of the price that covers the work already done and the materials bought for it, and refund the rest.
8. Digital products
The Yvine Shopify theme and other digital products are licensed, not sold. Their use is governed by the license terms shown on the product and activation pages. You get access after payment, through the activation link in your order confirmation. For digital content, the 14 days to cancel run from the day of purchase and end once you start the download, after you agreed when you bought to get access right away and acknowledged that you then lose your right to cancel; your consent is saved with your order and shown in your order confirmation email. On top of this, the Yvine theme has our voluntary 14-day money-back guarantee: if Yvine isn't right for your store, ask within 14 days of purchase (email yvinedesign@gmail.com with your order number), also after the download. We refund the full price to the payment method you used and switch your license off; from then on the theme may no longer be used. See the Refund policy.
9. Liability
- We are liable to consumers as the law requires. We are not liable for indirect or consequential loss, for loss caused by events beyond our reasonable control (for example strikes, carrier failures, natural disasters), or for misuse of an item. This does not limit liability for intent, gross negligence, death or personal injury, or rights that cannot be limited by law.
- For business buyers, our total liability for an order is limited to the price paid for that order.
10. Law and disputes
- These terms are governed by the law of Estonia. If you are a consumer living in another country, you also keep the protection of the mandatory consumer law of your country.
- Please contact us first; we answer every message. If we cannot agree, a consumer may turn to the Consumer Disputes Committee of the Estonian Consumer Protection and Technical Regulatory Authority (ttja.ee) or to a court. Disputes with businesses are settled by Harju County Court.
11. Changes
We may update these terms. The version published when you placed your order applies to that order.
